Service Agreement

Kindly make sure you have attentively read and fully understood our Usage Terms. Every part of zestzebraa’s Usage Terms is detailed below and can be reviewed by accessing the respective links. It is mandatory to have read and acknowledged our Service Agreement, which includes the Usage Terms, before signing up as a zestzebraa member. When you register on zestzebraa, you affirm your agreement to follow our Usage Terms, Privacy Standards, and Gameplay Directives. Any interaction with our Services, Games, or related applications binds you entirely to our Service Agreement. We hold the authority to update or modify our Usage Terms at any given moment. If updates are applied to the Usage Terms, we will alert you through your linked email. The modifications will also be posted on our website. Changes may be initiated due to internal Policy adjustments and Game Rules updates. In case you do not agree with the changes, you may discontinue our Fantasy Cricket Services by submitting a deletion request. Continued participation in our Services after such updates confirms your acceptance of the altered Service Agreement and latest Usage Terms.

No Warranty Assurance

zestzebraa strives to present information that is truthful, dependable, and up-to-date at the time of release. However, zestzebraa offers no assurances about the precision, completeness, or relevance of any data found on its site or within its guides. All content and graphics are shared “as available” without any kind of expressed or inferred warranty. zestzebraa refutes all inferred guarantees, including those concerning quality, suitability, ownership rights, and compliance. While zestzebraa aims to provide premium Services to its users, we extend no promises about the accuracy, effectiveness, integrity, or legitimacy of our Games, Platform, or Software. We cannot ensure our Games, Servers, or Software are error-free, timely, uninterrupted, or free of malware. zestzebraa solely holds the authority to decide accountability during technical problems or interruptions. If intentional interference is detected as the source of these issues, we reserve the right to block your profile or restrict game entries. zestzebraa bears no obligation for potential prizes forfeited from unfinished Games or Competitions.

Permitted Software Usage

Using our Software with commercial objectives is entirely banned. The Software is strictly meant for non-commercial, recreational use. No one may utilize their zestzebraa.com profile for anything outside of entertainment-based gaming. It is strictly restricted to modify, decode, or deconstruct the Software. The usage of AI-powered systems like bots is completely prohibited. All gameplay within Fantasy Cricket must be executed manually by users via the official Software tools.

Secure Your Password

Once registered on our system, securing your login credentials is your exclusive obligation. Avoid sharing it with peers, family, or any unauthorized individual. We waive all accountability for breaches resulting from another party gaining access through your credentials.

Who Can Join & Where

• Only individuals aged 18 years or older are allowed to participate in our Competitions.
• Only those who currently dwell within Indian territory are permitted to join the Competitions.
• In alignment with legal rules in certain Indian territories, zestzebraa may block participation from specific states. At the moment, individuals located in Assam, Andhra Pradesh, Tamil Nadu, Odisha, Telangana, Nagaland, or Sikkim are barred from participating in money-related Competitions due to local laws restricting involvement in such digital games.
• Participants are required to hold a valid email address to be eligible for Competitions.
• Eligibility to join and potentially win is granted only to those who’ve officially registered on zestzebraa.com and pre-registered for a Competition as described earlier.

Breach & Penalties

If any violation of our Terms of Use is discovered through investigation, or if your continued access appears to negatively impact zestzebraa, its players, or the public interest, we may take the following measures at our discretion:

1. Restrict matchups between suspected collaborators or rule-breakers;
2. Irreversibly suspend your account on our Website;
3. Confiscate the funds in your account;
4. Seek restitution for damages via legal or civil proceedings, including prosecution where applicable;
5. In serious breaches, we reserve the right to block your future registrations on our platform.

All decisions made by the zestzebraa administrative team regarding breach-related actions are definitive and binding. Our actions are not exhaustive of our rights or remedies under prevailing law.

Legal Jurisdiction, Conflict Resolution, and Law

This Service Agreement is subject to and governed by Indian law. All conflicts and grievances shall be arbitrated as per the Indian Arbitration and Conciliation Act, 1996.

Site Content

All content found on our platform—including text, visuals, trademarks, icons, images, and software (collectively referred to as “Site Content”)—is safeguarded under intellectual property legislation. In addition, any chats, emails, uploads, or content shared by Users may be recorded and considered part of the Site Content. zestzebraa reserves the right to utilize such material in any form.

Links or references to external websites may appear on our platform. We are not accountable for third-party content, and provide no warranties regarding its accuracy, completeness, or reliability. You assume full risk if you rely on such external content.

Visiting third-party websites through content posted on zestzebraa.com means you’re subject to the respective terms of those sites. We neither control nor are responsible for their content. A link on our platform does not imply endorsement of the third-party site.

Contest Types

• zestzebraa offers two distinct Contest formats: (1) Open Entry Contests where anyone may join without restriction, and (2) Private Contests where only invited participants may enter. All rules provided herein apply to both formats.
• Open Entry Contests
  • In Open Entry Contests, zestzebraa may host events with varying participant counts—2, 3, 5, 10, 100, or other set numbers.
  • These may be offered as paid Contests with winners declared post round conclusion.
  • Each Contest will list the participant requirement needed for activation. If this quota is met, the Contest proceeds. If not, and the round start time arrives, the Contest is canceled and entry fees are refunded in full.
  • Some Contests, called “Confirmed Contests”, become active when the required number of winners is reached—even if all participant slots remain unfilled. Participants may still join such Contests until either all slots are filled or the round begins. If the Contest is not activated in time, entry fees are refunded without penalty.

Exclusive Entry Contests

• For Private Contests, users can create exclusive matches, invite others to join, and choose between formats with 2, 3, 5, or 10 participants. The creator pays the entry fee, names the Contest, and receives a unique League Code. Only the Contest name can be altered after creation. The creator must provide zestzebraa with email or Facebook info of invitees so that invitations can be sent.
• To join a Private Contest, invited Users must enter the Contest Code and pay the entry fee. Once the participant cap is reached, no further entries are allowed. If the target number isn’t met one hour before the match, players may choose to convert the Private Contest into a Public one. zestzebraa cannot guarantee this conversion before start time or assure additional participants. If under-filled at the start, entry fees are refunded in full.
• Participation of invited Users is restricted to the set participant number. zestzebraa is not responsible for technical issues or ineligibility preventing any invited User from joining.

Liability & Compensation

By using our Services and participating in Contests, you agree to defend, indemnify, and protect us against any legal claims or expenses (including legal fees and indirect damages) that arise due to:

1. Copyright or intellectual property violations caused by content you upload;
2. Inappropriate, harmful, or unlawful behavior from other users, including misleading or explicit content;
3. Misuse, exploitation, or abuse of your account;
4. Any interruptions, errors, delays, data corruption, viruses, or technical disruptions during access;
5. Unauthorized account usage, regardless of whether it was permitted by you.

Governing Law & Court Jurisdiction

These Terms and Privacy Policy are interpreted in accordance with Indian law. Any disagreements shall be addressed by courts in New Delhi exclusively.

Return & Refund Policy

All payments, deposits, and fees on zestzebraa.com for Fantasy Cricket are final. No refunds are processed unless a transaction error occurs. Customer satisfaction is valued, but only such error-based claims will be reviewed.

If you feel dissatisfied with any payment, acquisition, or charged fee on zestzebraa and believe a mistake has occurred in the process, kindly inform us within three days of the transaction. We will assess the issue and decide the outcome solely at our discretion.

zestzebraa retains the authority to annul any match at its sole discretion, with or without explanation, and promptly return all fees paid by any participants involved.

Users are strictly prohibited from entering any game rooms once the corresponding cricket match (as defined by the Series) has commenced.

Legality

• Skill-based gaming is permitted under Indian law, as it is not covered under the scope of gambling regulations such as the Public Gambling Act of 1867. The Supreme Court of India, in its rulings in State of Andhra Pradesh v. K Satyanarayana (AIR 1968 SC 825) and KR Lakshmanan v. State of Tamil Nadu (AIR 1996 SC 1153), confirmed that games largely influenced by expertise, learning, concentration, prior exposure, and dexterity qualify as games of skill.
• The Site Content presented by zestzebraa consists of skill-centric games wherein a Participant’s triumph hinges chiefly on their comprehensive understanding of cricket and/or football and/or kabaddi metrics, insight into players’ relative performances, situational awareness, and format nuances (ODIs, Tests, T20s for fantasy cricket), along with their focus and tactical proficiency in game participation. Players must form optimal teams using restricted resources and employ timely swaps to amass the highest scores.
• By engaging in any of our Contests, each Participant affirms and consents that they are engaging in a skill-driven game, not one of luck.

Fantasy Tally and Feeds

The zestzebraa Fantasy Cricket interface might source scoring data and auxiliary stats essential for calculating and displaying points from external vendors. Should any discrepancies or flaws arise in point calculations, winner selection, etc., stemming from errors or omissions in data from said vendors, zestzebraa.com will endeavor to correct such issues prior to award distribution. Nonetheless, zestzebraa.com emphasizes its reliance on third-party statistics for accuracy and completeness and disclaims any responsibility for errors in score computation or winner determination due to flawed data. Users acknowledge not to pursue any legal remedy or lodge complaints against zestzebraa for this reason.

Starting Line-up Feature: Information regarding a player's presence in the final line-up is solely for reference to help users finalize their team on zestzebraa. This inclusion is based on data from feed providers and publicly accessible sources. Users are strongly encouraged to independently verify such data via credible and official outlets. zestzebraa assumes no liability if a player previously listed as ‘Playing’ ends up not participating for any reason.

Bonuses: The terms below are applicable to every Fantasy Cricket-related Bonus and Offer (Instant Bonus, Referral Bonus, Complimentary Bonus, Earnings Bonus) provided on www.zestzebraa.com and all Users receiving any such Bonuses are subject to these conditions:

Free Bonus: This bonus initially gets added to your Bonus account and transitions into your Balance Account as you participate in game rooms and settle match fees. The bonus transfers at a 4% rate of the Match Fee for each Fantasy Cricket room joined and completed, regardless of the outcome.

Immediate/Deposit Incentive: This type of bonus is granted to you instantly. Every time you deposit, the full reward is straightaway applied to your Account Balance, making it readily usable for gameplay. On the other hand, a ‘Delayed Bonus’ dispenses a fractional portion of your bonus tied to each match fee in every Fantasy Cricket contest you take part in, thereby unlocking slowly.

Companion Invite Incentive: This acts as a direct bonus. When someone you referred enters a paid game room on zestzebraa.com (by making a deposit, joining, and finishing a real money game), you obtain an Immediate Bonus for bringing them on board.

Rewards: Rules and Provisions

1. A participant is entitled to earn only one reward per calendar day.
2. All reward alerts will be delivered to victors via email 24 hours after match conclusion.
3. If a participant secures multiple prize contests in one day, the reward will be assigned to the first contest they joined. In the remaining contests, the second-highest scorers will claim the rewards.
4. Each participant is limited to one slot in any Free Entry Cash or Item-oriented contest. Using more than one account in Fantasy Cricket contests is strictly banned.
5. All shipment, handling, and import fees tied to rewards are solely borne by the winners.
6. All awards are liable for TDS cuts in accordance with the Income Tax Act 1961. Victors will be issued TDS receipts. Winners are also accountable for any further tax duties such as income or gift tax related to their reward.
7. By downloading and/or accessing the official zestzebraa application, you fully agree and accept the following:
   • zestzebraa, alongside its divisions and associated groups under the zestzebraa brand, assumes no responsibility for the application or its embedded content. Your usage of this application and the site is strictly for personal, non-assignable use.
   • zestzebraa does not provide any guarantees about the Website or its Materials. All complaints, losses, liabilities, or expenses stemming from using zestzebraa Services, Website, or its Materials are the user's sole burden. zestzebraa is under no duty to resolve any grievances or obligations linked to user experience involving the Website, its Items, or Services.
   • zestzebraa renounces all accountability in cases where a third party claims your use or possession of their intellectual property violates their rights.
8. Participation in zestzebraa’s Fantasy Cricket events is open to all Indian regions except Assam, Andhra Pradesh, Tamil Nadu, Odisha, Telangana, Nagaland, and Sikkim.
9. All regular zestzebraa policies and regulations are in effect.
10. For any disagreement, the decision made by zestzebraa Administration shall be considered definitive and binding.
